As long as the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.

Limited warranty

The product is assured to maintain its ability to withstand impacts from handgun fire in accordance with its certification for a period of seven (7) years. Should it fail to meet this assurance, Bini LLC will, at its discretion, provide repairs, replacement, or a refund of the cost. Exterior materials have one (1)  year limited warranty.

All warranties become null and void once the product undergoes a shooting event that surpasses its certified limits in terms of bullet caliber, velocity, angle of fire, or quantity of impacts it was designed to withstand.

In the event of a failure to meet the certified standard during a shooting incident, Bini LLC’s liability will be restricted to a maximum amount not exceeding the original sale price of the product to you.

Limitation of Liability

To the maximum extent permitted by law, under no circumstances, including but not limited to contract, tort, negligence, strict liability, warranty, or otherwise, will the Bini LLC entities be liable to you or any other person or entity for any indirect, consequential, exemplary, incidental, special, or punitive damages, or lost profits arising from or related to these terms of use or your use of the products.

Your access to and use of the products is at your own discretion and risk, and you are solely responsible for any damages or injuries resulting from the product failing to perform up to the standards to which it is certified.

In no event will the aggregate liability of the Bini LLC entities exceed one hundred U.S. dollars ($100). The limitations outlined in this section apply to any theory of liability, including but not limited to warranty, contract, statute, tort (including negligence), or otherwise, even if the Bini LLC entities have been advised of the possibility of such damages, and even if any remedy set forth herein is found to have failed its essential purpose.

If you are dissatisfied with the products or the terms of use, your sole and exclusive remedy is to discontinue using the products.

Limitations on Use  

Not all Products offered by Bini LLC are available to all persons or in all geographic locations. Bini LLC reserves the right to limit the provision of Products to any person and geographic area. You agree to comply with all applicable laws and local rules regarding purchase of defense articles.

Payments

We accept payments in the form of ACH, Mastercard, VISA, American Express, Discover, and check. Payments must be made in U.S. dollars. 

Third-Party Claims

Our company shall not be held liable for any claims, damages, or injuries resulting from the use or misuse of our our products by third parties.

Exclusion of Consequential Damages

 In no event shall our company be liable for any incidental, consequential, or punitive damages arising from the use of our products, including but not limited to loss of business opportunity, loss of profits, or loss of life.

Indemnification

Users agree to indemnify and hold our company harmless against any claims, damages, or liabilities arising from their use of our products, including legal fees and expenses.

Conditions of Sale

By purchasing and using our products, users acknowledge and accept these limitations of liability. It’s essential for users to use our products responsibly and in accordance with all applicable laws and regulations.
